I. What does “personal data” mean?
Personal data means any information relating to an identified or identifiable natural person, e.g. your name, address, telephone number, email address or date of birth. Non-personal data on the other hand are information that cannot be connected to a natural person, e.g. the number of users visiting our website or any other kind of aggregated information.
II. What data we collect
In order to operate Cawemo as well as, partly, the Website, we need to collect and process certain data (personal data and other data). Thus, we collect and store data if you visit the Website, get in touch with us and/or use Cawemo, as explained below.
- Visiting the Website and using Cawemo
When you visit our Website, we will collect and store data in the following ways:
- General Log Files
Whenever the Website is visited, our web servers automatically collect and store certain information in what is known as log files (the “General Log Files”). A General Log File contains only certain data on the hardware of your device.. This information will be stored separately and can and will not be combined with personal user data (such as data on your Cawemo account et al.). We merely use the General Log File in order to better analyze cases of disturbance in the availability of our server. The data is usually deleted after 24 hours.
- Cawemo Log files
When you have opened a Cawemo account and use Cawemo (see section II. 3. below) we will log your user ID (the email you use to log onto Cawemo), the URLs of the webpage that you are visiting at the time of logging, the respective referrer URL, and information on your browser environment (browser type, version, operation system etc.) (the “Cawemo Log Files”), and store Cawemo Log Files for up to 6 months.
We have to log data more extensively in order to
ensure the continued and best possible operation of Cawemo for you and to detect and fix any incidents that may be in the way of providing the best possible service for you;
We and our partners use various technologies to collect and store information when you visit our website and use our service. This may especially include cookies (small text files stored locally via your browser on your device ) or similar technologies to identify your browser or your device.
We use an authentication and session cookie (cawemo_sessionid) to automatically identify your browser or your device when you log in as a registered user (regarding the registration see section II. 3. below). It also serves as an identifier that saves you from having to log in repeatedly, provided to do not actively log out. At the same time, the cookie serves as a session cookie. Accordingly, the following data is stored in our authentication and cookie: your user credentials as well as the information on the then-current session. The cookie is automatically deleted when you log out, or after one year of inactivity at Cawemo on your part. You can, of course, also delete the cookie manually at any time.
In addition, we use Google Analytics as a web analytics service.
Google Analytics is a web analytics service provided by Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). It sets one or more analytics cookie (“_ga”, used to distinguish users; “_gat”, used to throttle request rate and possible others). Google uses such cookies to help us analyze how users use our website and services. The information generated by the cookie(s) about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. The IP address will, however, be truncated and therefore anonymized before transmission. On our behalf Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet activity in connection with the use of the website. - Payment Services
Whenever you pay for your use of Cawemo, you will do so via the payment service provider “Chargebee”. Chargebee will provide its services directly to you and will therefore directly collect your personal data. Cawemo does not assume any responsibility for such payment data. When you get directly in touch with us through our general contact channels, e.g. via our online contact form or via email, we will collect and store the data (including personal data) you provide us with during the communication in order to adequately respond to, and further manage, your request. In particular, this may, as applicable, apply to your email address, your name, your query including the information embodied in it.
Registering and logging in
If you register for Cawemo as a user and, consequently, you enter into a corresponding contract with us on the use of Cawemo (“User Agreement”), we collect and store all data (including personal data), that you provide us with during the registration process and/or under the User Agreement. This data may, in particular, include your name and email address as well as the password you have chosen (the latter we store in encrypted form only). For invoicing purposes we will also ask you to provide the necessary invoicing information. In addition you may provide optional data such as a user photo.
You may also register with us using your Google account. This allows you to use certain data stored by Google in relation to your account there to start your Cawemo user account and, subsequently, log into your Cawemo account. We may then ask you to complete the necessary account information as applicable.
In addition to certain basic profile information (e.g. your user name) we also receive the email address you use for your Google account as we need this address to initiate and, subsequently, administrate your Cawemo user account.
III. How we use data we collect and store
We use personal data provided by our users and/or customers only in order to operate Cawemo and run the Website, for contractual purposes and for responding to our users’ enquiries. When you contact us, we keep a record of your communication with us in order to help solve the respective issue. For example, we use your email address to send you your registration confirmation (via a double opt-in method) as well as to later contact you about matters concerning your user account and/or with regard to contractual matters.
We use the Cawemo Log Files as well as your account information to, where applicable, calculate and invoice any fees due to us as a result of your use of Cawemo.
We use your email address to, in addition to any direct contractual communication we may have with you, inform you on any new developments regarding your processes in Cawemo in order to allow you to make full and the best use of Cawemo and its collaborative elements (such as “Another user has asked you a question”).
Any optional data you may have uploaded (such as your user photo) will only be used for allowing you to use your user account as desired.
Limited third party transfer
We will not disclose or share personal data with third parties, except
- if and to the extent necessary for the performance of the contract we have with you or in order to enforce any claims we are entitled to,
- if you have given your consent to such disclosure,
- if we are required by law or ordered by a court to disclose such information.
IV. Your rights of access
Upon your request we will provide you with
confirmation as to whether or not personal data relating to you are being processed and information at least as to the purposes of the processing, the categories of data concerned, and the recipients or categories of recipients to whom the data are disclosed; and/or
information on the personal data undergoing processing, and of any available information as to their source.
Further, we will, upon your request,
rectify, erase or block all or part of your personal data if the data or, as the case may be, the processing of the data do not comply with the applicably statutory provisions, in particular because of the incomplete or inaccurate nature of the data; and/or
notify any third parties to whom your personal data have been disclosed of any rectification, erasure or blocking carried out in compliance with the preceding paragraph, unless this proves impossible or involves a disproportionate effort on our part.
